This Terms of Service Agreement constitutes a contract between you and
NZwide.com. The terms and conditions set out in this agreement govern the
use of all products and services provided by NZwide.com. Before purchasing
any of our goods or services, please read our conditions carefully to be sure
you understand them.
The following basic rules apply to all of Our Services in addition to the Terms
of Service:

General Terms
We cannot promise that the domain name you want to register will be
registered or that it will be registered in your name. Please wait to assume
that your preferred domain name(s) have been registered until you have
received confirmation that they have been registered successfully.
The terms and conditions outlined by the appropriate naming authority apply
to the registration and use of your domain names. This authority of domain
registration for names ending in .COM, .NET, and ORG, whereas regional
domain authorities are in charge of domains ending in particular nations. You
must assure compliance with these terms and conditions by becoming
familiar with them. Please be aware that if your request to register a domain
name is denied, you have no legal recourse against us. Regardless of whether
the naming authority chooses to reject your proposed domain name, please
be informed that any administrative fees paid to us are non-refundable.
We are not liable for any problems that result from your usage of a domain
name. You and any other person involved must address any disagreements
immediately between yourselves. In the event of such a disagreement, we
reserve the right to withhold, suspend, or cancel the domain name at our
discretion and without providing a reason. Furthermore, we are free to discuss

the issue with the pertinent naming authority at our discretion; but, we are not
required to take part in the dispute.
To transfer a domain to another provider, we must receive complete payment
for that domain. The fees for the services you receive will be based on the
rates and scale of fees announced on our website, and they must be paid in
advance prior to our services being provided.
In addition to the other rights and remedies set out in this Agreement, we
retain the right to stop providing you with services if any payments are not
made by the due date.
Due to our providing of services to you and your use of the services, you are
liable for protecting us from any violations of these business terms and any
claims made against us by third parties. Without prior warning, services may
be immediately suspended and this Agreement may be terminated if the
necessary sums are not paid on time.
If you break any of these terms and conditions and you fail to correct the
breach within seven (7) days following written notice from us specifying the
breach, we may terminate this Agreement forthwith.
We retain the right to cancel this Agreement immediately if your firm falls into
insolvent liquidation, hires an administrator or administrative receiver, or
enters into a voluntary agreement with creditors. We reserve the right to ban
your website and erase all data stored on it if this Agreement is terminated or
the Services are suspended.
While we have the right to erase such data, we may preserve it at our
discretion for a length of time during which you can arrange for its collection
at your expense, provided that all outstanding and unpaid sums are properly
resolved.

Please keep in mind that NZwide.com is not responsible for any losses your
company may sustain. PaidBoom makes no implied or explicit guarantees for
our services. NZwide.com makes no express or implied warranty of
merchantability or fitness for a specific purpose. This includes any data loss
caused by NZwide.com delays, non-delivery, wrong deliveries, or service
outages.
Account Eligibility
By registering for and utilizing our services, you confirm that you are at least 18
years old. Our services are intended for users who are 18 years of age or older.
Any registration, usage, or access to our services by individuals under 18 years
old is a violation of this Agreement. If you are using our services on behalf of
another party, you assert that you have the authority to legally bind such
party to this Agreement and to act on their behalf in connection with the
services.
Having multiple accounts for the same client is strictly prohibited. If we
discover any instances of this, we reserve the right to terminate your
accounts without prior notice. It is your responsibility to provide accurate,
complete, and up-to-date customer information when filling out registration
forms. Furthermore, the email address used for registration must be different
from the domain you are signing up with.
We will use the email address you supplied if we need to get in touch with you.
You assume full responsibility for all actions taken using your account by
accepting this. Your account's security is entirely your responsibility.
Any request for a dedicated IP address must be justified by IP. The Indian
Registry for Internet Names and Numbers (IRINN), the American Registry for
Internet Numbers (ARIN), and the Réseaux IP Européens Network Coordination
Centre (RIPE) may all need changes to the IP justification policies. You agree
that there will be a $10 charge for each time the primary domain linked to an
account is changed.

Website Migrations
Our website migration service is provided as a courtesy. Our team will make
every effort to help move your website to us, but we do not make any
guarantees regarding the availability, possibility, or time required to transfer
an account.
User Content
Through our Services, you may have the ability to upload, store, publish,
display, and distribute various types of content, including information, text,
photos, videos, and more (collectively, "User Content"). User Content includes
any content posted by you or by users of your websites hosted by us. It is your
sole responsibility to ensure that User Content complies with the terms of this
agreement.
NZwide.com does not exercise control over User Content or the content of any
information transmitted through NZwide.com's computers, networks or points
of presence. We do not actively monitor User Content.
You acknowledge and agree that NZwide.com, in its sole discretion, may take
corrective action, including, without limitation, removal of all or part of User
Content or User Websites, as well as suspension or termination of all Services
without providing a refund if you violate the terms of this Agreement. You
hereby agree that NZwide.com will not be responsible for any actions taken
as part of the corrective measures implemented.
Account security and systems NZwide.com
It is your responsibility to ensure the security of scripts, programs, and proper
permissions on directories and files installed in your account, regardless of
installation method. You are responsible for all activities under your account,

including the compromise of login credentials such as usernames and
passwords.
The Services, including associated equipment, networks, and network devices,
are provided solely for Customer's authorized use. While NZwide.com reserves
the right to monitor our systems, it is not obligated to do so. Monitoring can
occur to ensure authorized use, protect against unauthorized access, verify
security procedures, ensure survivability, and maintain operational security.
During monitoring, information may be examined, recorded, or copied for
authorized purposes. By using our services, you agree to the monitoring of
network services for these specific purposes. Any account found connecting
to a third party network or system without proper authorization is subject to
suspension.
We offer comprehensive protection against a variety of malicious activities,
such as denial-of-service attacks, brute force attacks, spam, and spam. Any
account found to be engaging in such activities may face suspension or
termination upon filing an abuse report. Failure to promptly remove malicious
content, as reported, may temporarily disable access to the service. In
addition, we reserve the right to charge fees for confirmed cases of abuse.
To reinstate account privileges after an incident of abuse, the abuse fee must
be settled prior to reactivation. Our approach to handling cases of abuse may
be subject to discretion. For detailed information on our abuse fee schedule,
please see below.

First, notice no charge. (Service will be suspended if not entertained in 12
hours)
Second notice: $5 penalty.
Third notice: Account Termination.

Service Cancellation
Cancellation of the Product or Service may be initiated by the customer or by
NZwide.com. No third party entity, service or jurisdiction may request or
enforce the cancellation of a service on behalf of a customer.
Customer Initiated Service Termination:
To cancel a Product or Service, customers must submit a proper cancellation
request. The customer can use the cancellation option available in the
Customer Control Panel or submit a cancellation ticket to the Billing
Department, providing a clear explanation of the cancellation.
Customers should be aware that there are two types of service cancellation
depending on the chosen cancellation period specified in your request.
For shared/cloud web hosting accounts, customers acknowledge and agree
that NZwide.com will not retain a copy of the account or any backup after the
cancellation request is activated and the Product or Service is cancelled. All
data associated with the shared web hosting account, including any
backups, will be permanently deleted.
Regarding the VPS or Dedicated Server services, the client's data will be kept
for a maximum of 24 hours from the date the cancellation becomes effective.
After this period, the entire server will be deleted, resulting in permanent
deletion of all hosted data with no restore option.NZwide.com cannot be held
responsible for any data loss due to Service suspension or termination. It is
the customer’s sole responsibility to keep the data of their Web Hosting
accounts fully backed up remotely for any loss of data to be avoided.
Service Cancellation by NZwide.com
The customer agrees and acknowledges that any Product or Service offered
by NZwide.com can be canceled anytime by NZwide.com with or without
reason. Neither canceled by NZwide.com services are not subject to partial or
full refund nor is NZwide.com obligated to give any prior notice to the

customer. NZwide.com will not be held responsible for any loss of data in case
the service is canceled by us.
The customer agrees that the reason for the cancellation of service by
NZwide.com can be but is not limited to:
Violation of NZwide.com Terms of Service: In the event of a violation of the
NZwide.com Terms of Service, including engaging in activities that are illegal
or prohibited under our Terms of Use, NZwide.com will take appropriate action
based on the severity of the violation. In most cases, we will do everything
possible to resolve the issue before resorting to full termination of service.
This means that we will open a Support Case with a complete description of
the violated terms and give our customers respectful time to resolve the
outstanding case:
Cancellation deadlines:
For our shared web hosting products, the cancellation period is set at 7 days.
In the case of VPS products and Dedicated Servers, the cancellation period is
3 days. The countdown to the cancellation period begins immediately after a
case is opened in our ticket system. It is the client's responsibility to know the
case and resolve it within the stipulated period.
Backup file provision:
Upon termination, NZwide.com will immediately provide Customer with a
backup file containing all Customer Data hosted on the terminated or
terminated Service. The backup file will remain accessible for download for a
period of 7 calendar days from the time it becomes available. It is the
customer's responsibility to ensure the complete download of the backup file
within the designated time frame provided by NZwide.com.

Refunds for breach of terms of service:

In cases where the reason for service termination by NZwide.com is not due to
a violation of the Terms of Service by the customer, a prorated partial refund
will be issued. The amount of the refund is calculated based on the total
prepaid amount minus the remaining months of service multiplied by the
price per month of the canceled service.

Refund Options:
NZwide.com offers several refund options for customers to choose from. If
PayPal is used as the payment method, the refunded amount will be
automatically sent to the customer's PayPal account.

HIPAA Disclaimer:
Please note that we are not HIPAA compliant. Customers seeking the secure
storage of "protected health information" as defined in the federal Health
Insurance Portability and Accountability Act (HIPAA) are strictly prohibited
from using our services for such purposes.
Billing and Payment Information
It is your responsibility to maintain accurate and up-to-date payment
information and to ensure timely payment of all invoices. By agreeing to these
terms, you acknowledge that payment for services must be made prior to the
service period. In accordance with applicable laws, rules and regulations,
payments received will be applied to the oldest outstanding invoice in your
billing account.

Unless otherwise specified, you will be automatically billed on a recurring
basis to avoid service interruptions. All invoices must be paid within 2 days of
the due date indicated on the invoice. Failure to settle an invoice within 2 days
may result in the suspension of your service.

Access to your account will be restored upon receipt of payment. In addition
to the invoice amount, a 10% late fee may be charged. The misuse or

fraudulent use of credit cards, charge cards, electronic funds transfers,
electronic checks, payment methods or identities is strictly prohibited under
this Agreement.

Cases of misuse or fraudulent activity will be reported to the appropriate
government and law enforcement authorities, credit reporting services,
financial institutions and credit card companies. Invoices for recurring
services on a monthly, quarterly, semi-annual, annual, biennial and triennial
basis will be issued 7 days before the due date. Failure to pay for services
within 2 days of the due date will result in suspension of service.

If an invoice remains unpaid for 7 days after the due date, your service will be
canceled and all associated data will be deleted. You have the right to
dispute an invoice with NZwide.com before the due date. If you have any
questions about the charges on your account, please contact our billing
department for assistance. Opening a dispute with your credit card company
or initiating a chargeback is considered a violation of this agreement and
may incur an additional $75 chargeback fee.

Money back guarantee

NZwide.com offers a 30-day money-back guarantee for shared, premium
and VPS accounts. To be eligible for a refund under our money-back
guarantee, you must meet the following requirements:

Must not have been a previous customer of NZwide.com.
No abuse or misuse of the Service should have occurred, as described in
NZwide.com's Account and System Security, CPU, Bandwidth and Disk Usage
policies.
You must not have started a dispute or chargeback.
Must have been a customer in good standing of the service for a minimum of
20 days and a maximum of 30 days.

The money-back guarantee applies on an annual billing cycle basis.
Any violation of this agreement will cause you to waive your right to a refund.
Refund Policy
All refunds, including fees associated with core services, additional features,
and any pre-assessed setup fees, are at the sole discretion of NZwide.com. It
may take 5-7 days for the refund process to be fully processed and credited
to your account.
Conditions of Registration, Renewal, Transfer and Administration of Domains:
1. The prices of the domains can vary according to the internal policies of
the system.
2. The above price does not apply to premium domains. Premium
domains are usually short, consisting of one word or 3-5 letters. They
may be referred to as "post-sale" or "pre-registered" domains. Most
premium domains have a .com extension, but they can also end in .org,
.net, .biz, etc.
3. When you register or transfer a domain to another registrar, the domain
will be locked for 60 days in accordance with REGISTRAR's transfer
policies. During this period, the domain cannot be transferred.
4. Once you register or transfer a domain to NZwide.com, it cannot be
replaced or refunded. Please carefully consider your choice of domain
name before making any payment.
5. DNS Management: Currently, you can only change the nameservers on
our site. For any other DNS settings or connections, please contact our
support team. For advanced DNS configuration, we recommend using
Cloudflare, which offers free services.
6. After a domain expires, domains unlock and authorizations are not
available. You must renew your domain with us before you can transfer
it.

7. Expired domains may not appear in your account as they go through a
deletion process by the registry.
8. Once your domain expires, we are not responsible for it. However, we
can try to renew the domain upon receipt of your payment.
9. Redemption or grace fees may apply if the domain has expired. The
redemption or grace fee can range from INR 8,000 to INR 15,000
depending on the registrar.
10. Our domain management tool is currently in beta and errors may
occur. If any issues arise, such as your site being suspended, please
contact us and we will do our best to resolve the issue. However, we
cannot guarantee a solution.
11. We use a reseller panel, APIs, and other tools to manage domains from
multiple registrars.
12. Real-time domain registration features are not available. Once we
accept your order, the normal domain activation time can take up to 48
hours or more.
13. Due to the lack of real-time domain registration, multiple users can
request the same domain and activate it on multiple accounts.
However, ownership will be given to the first user to make the initial
payment in our system. The first paid user can claim the domain at any
time during its term.
14. In the event that multiple users make simultaneous payments for the
same domain, an ownership dispute will arise.
15. Ownership disputes: In cases of ownership disputes, we will facilitate a
group discussion between the users involved. If an agreement is
reached on the final owner, it will be accepted. Otherwise, the domain
will be deleted. NZwide.com will not determine ownership.
16. Domains can be removed at any time if they violate our terms of
service or upon receipt of reports of inappropriate activity.
17. Country-specific Top Level Domains (TLDs) may require additional
eligibility criteria and documentation depending on the respective
government and registry agencies.

18. Failure to provide the required documents and information may result
in the suspension of your domain.
19. Country-specific top-level domains (TLDs) require additional eligibility
criteria and documentation in accordance with the respective
government and registry agencies. If you do not provide the necessary
documents and information, your domain may be suspended at any
time.
20. Free domains are only available with select annual plans and will be in
the .COM extension. Your domain will be free with your hosting plan. If
you do not renew your hosting plan, you will need to renew your domain
separately or transfer it to another registrar.
21. Our domain search system is currently in beta and cannot detect the
price of premium domains. If a premium domain has been ordered, it
will be cancelled.
22. Promotional prices and promotional codes are valid for new domain
registrations only. If you use them for renewal or transfer orders, your
order will be canceled and refunded.
Prohibited uses:

Using our services to infringes copyrighted material.
If you believe your copyrighted content has been infringed, please contact
support@NZwide.com
Use our services to host child pornography.
Using our services to harm other networks or computers in any way, including
but not limited to denial of service attacks, brute force attacks etc.
Using our Services to send bulk amounts of emails defined as more than 1000
emails per day including spam or bulk mail. If you plan to send bulk mail, you

must first get permission. Violators of this section will be reported to
SpamHaus.
Please note that the list of prohibited uses provided here is not exhaustive,
and additional restrictions may apply as described in our terms of service. If
you have any concerns or questions about prohibited uses, please contact
our support team for clarification.
Prohibited Materials:
The following is a list of materials that are prohibited at all times on our
servers.
Top Prohibited Sites:
 IRC Scripts and Bots.
 IRCD (IRC servers)
 Proxy Scripts, Anonymizers (includes Shadowsocks)
 Image Hosting Scripts (similar to Photobucket or Tinypic)
 AutoSurf, PTC, PTS, PPC sites.
 IP Scanners.
 Bruteforce Programs, Scripts, and Applications.
 Mail Bombers and Spam Scripts.
 Banner Ad services (commercial banner ad rotation)
 File Dump and Mirror Scripts (similar to Rapidshare)
 Commercial Audio Streaming (more than one or two streams)
 Escrow and Bank Debentures.
 High Yield Interest Programs (HYIP) or Related Sites.

Downloadable files, media, and databases must adhere to the following
limitations:

A maximum of 10 GB of a shared and cloud hosting account can be allocated
to music, video or other media files.
A maximum of 10 GB from a shared and cloud hosting account can be
allocated to archive and disk image files containing the complete content
and structure of a data storage medium.
A maximum of 10 GB of a shared and cloud hosting account can be allocated
to databases and database dumps, including but not limited to .sql files.
A maximum of 10 GB of a shared and cloud hosting account can be allocated
to executable files and all other files that are the result of compiling a
program.
File hosting is not allowed.

At its sole discretion, NZwide.com reserves the right to determine any type of
unfair or inappropriate use of any content, which may result in immediate
account suspension.
Cancellation:
NZwide.com reserves the right to cancel the service at any time. If an account
is terminated for a policy violation, there will be no refund. Customers can
cancel the service in accordance with the terms of their contract by email or
through the portal. Only authorized contacts or individuals can cancel an
account.
Unless the customer specifies an end date, accounts will be terminated upon
notice. Unless otherwise specified in the customer contract terms, for all
month-to-month services, notice of cancellation must be received at least 7
days prior to the scheduled service renewal date. Additionally, if service is
canceled with less than 7 days remaining before scheduled service renewal,
service will automatically renew for an additional month.
Cancellation requests must be submitted through the NZwide.com customer
area by selecting "Request Service Cancellation" in the left hand navigation
menu and submitting the cancellation form for services that are
discontinued. The aforementioned refund policies are strictly applied to all
canceled accounts. If an account is terminated for non-payment,
NZwide.com reserves the right to remove content without notice and re-
provision the server.
CPU, Bandwidth and Disk Usage:
Please refer to the terms and conditions or specific hosting plan details for
information on CPU, bandwidth and disk usage limitations. The resources
assigned will depend on the hosting plan chosen and any additional
provisions that are agreed upon.

All use of hosting space provided by NZwide.com is subject to the terms of
this agreement and the Acceptable Use Policy.
Shared and premium hosting space should be used exclusively for web
archives, active email, and user website content for SEO optimization. It is
important to note that the space should not be used for storage purposes,
including external storage of electronic files, email, or FTP hosting. We
diligently monitor CPU and disk usage and will notify you immediately in case
of excessive usage. Excessive CPU usage refers to any activity that
significantly impedes the ability of other users to access and use your
services effectively.

For dedicated and VPS usage, it's crucial to stick to the allotted resources
specified in your chosen plan or server. We actively monitor bandwidth usage
to ensure optimal performance.

Uptime Guarantee:
In the event you’re shared or premium server experiences physical downtime
that falls short of our 100% uptime guarantee, we offer compensation of 1
month of credit to your account. Please note that this warranty does not
apply to scheduled maintenance or force majeure situations. Server uptime is
defined by the uptime reported by the operating system and web server,
which may differ from other service reports. To request uptime credit, submit
a ticket to our billing department within 7 days of the actual downtime. It is
important to mention that uptime guarantees for dedicated servers only
cover network uptime, excluding events such as hardware failures, DDoS
attacks, any kind of other attack or acts of God.

Backups and data loss:

We provide a complimentary backup service that runs daily and retains 7
backups. However, it is essential to understand that only one week's worth of
backups are kept at any given time. As such, we do not guarantee the
availability of these backup copies.

Limitation of Liability:
NZwide.com, its directors, employees or agents shall not be liable for any
direct, consequential, incidental, special or punitive damages, including lost
profits or data, arising out of the use of our services or any user generated
content. User websites or materials accessed or downloaded through our
services. This limitation of liability applies even if NZwide.com was aware of
the possibility of such damages.

Affiliate Terms:
Our affiliate program is available for domains, shared hosting, and cloud
hosting. To participate, your affiliate account must be manually approved by
our team; otherwise, the payment will be rejected. We offer up to 50%
commission on shared hosting and cloud hosting sales. Sales can be tracked
using promo codes and links. However, keep in mind that domain sales can
only be tracked through promo codes. In our system, the promo code serves
as the primary identifier, ensuring that the affiliate commission is attributed to
the specific promo code owner. For more details, please contact our support
team. Payment for hosting sales will be issued after a period of 30 days from
the sale, while payment for domain sales will be processed on the 1st of each
month. We accept payments via Paytm, PayPal, UPI, and wire transfer.

Compensation:
By using our services, you agree to indemnify, defend, and hold harmless
NZwide.com, our affiliates, and our respective officers, directors, employees,

and agents. This indemnity clause remains valid even after the termination of
our agreement.
